bring a criminal prosecution and a civil suit on commercial law grounds
Explanation:

agree  Veronica Durbaca: yes, there is no such thing as a commercial action; the legal actions are of two kinds - civil and criminal. An action that is not criminal is a civil action (criminal lawsuits are the exception).

bring a criminal action and commercial litigation

Explanation:
bring a criminal action and commercial litigation

En Venezuela se llama “juicio mercantil”. Aunque no he traducido antes esta clase de demandas, encontré muchas referencias a “commercial litigation”; te copio algunas.

Saludos y mucha suerte.
