Law/Patents
Spanish term or phrase: demandante
Here is the backdrop to this question:

In a document dealing with an alimony case, the (male) payer of alimony is refered to at the head of the document as the "demandado" and the female receiver of alimony as the "demandante"

Later in the document, in a statement of terms of payment for the alimony, there is the phrase:

...se concede al promovente el siguiente plan de pago.
(this clearly refers to the male payer of alimony)

Later still, the social security numbers of the two parties are given, thus:

El numero de seguro social del promovente es XXX.

El numero de seguro social de la promovida es XXX.

From previous KudoZ inquiries, it was established that demandante=(female) petitioner and demandado=(male)respondent.

It was also suggested that demandante=promovente and that both of these terms could be translated petitioner.

Yet this seemingly cannot be the case, for "promovida" clearly refers to the female party (labeled as "demandante" or "petitioner" at head of document) in the case.

The question, then, is how each of the following terms are to be translated within the context of the present document [Puerto Rico] and who each term refers to:

demandante

demandado

promovente

promovida

I apologize for the long explanation but I know of no other way to attempt to clarify the matter.

Thank you so much.

I am suggesting that \"demandante\" does not have to equal \"promovente\" and that \"plaintiff\" does not have to always be the same as \"petitioner\". Why? Because the petitioner may be responding to the original plaintiff and thus become the petitioner while

simultaneous being the defendant from a former part of the lawsuit.

Thus, they do not have to be the same, although they usually are.

Explanation:
Being the one who files a complaint. And the demandado would remain "respondent" (he is not accused or defending himself).

The female gender of "promovida", IMHO, does not refer to the female promovente (petitioner) but rather to the "parte promovida".
