Spitzer last month charged the world's No. 1 insurance broker with price rigging, which he said sprang directly from contingent commissions paid to Marsh by insurers.
Marsh's new Chief Executive Michael Cherkasky, who took over from Jeffrey Greenberg last week, has said clearing up legal issues with Spitzer was his priority, and a settlement is expected over the coming weeks.
Marsh said Monday it will put the collected fees -- which it estimated to be about $230 million -- into a segregated account to be used for any restitution agreement it reaches with Spitzer.
The broker said last week it would permanently drop contingent commissions -- which it calls "market services agreements " -- by the beginning of next year, while it will disclose all commissions and fees to clients.
Contingent compensation fees, which Spitzer says Marsh forced on insurers under the threat of cutting premiums placed with them, totaled $845 million last year, or 7 percent of Marsh's $11.6 billion in revenue.
Spitzer accused New York-based Marsh in an Oct. 14 lawsuit of rigging bids and colluding with American International Group Inc. and other insurers to fix prices.

From energy and water savings to local and healthy materials, the tenets of green building are being introduced in more and more projects, all over the world. As cities become ever more densely populated and as resources become more scarce and expensive, it is clear that the way we make our buildings must change. Green building goals are becoming mandated by agencies and jurisdictions and even required by building codes – these moves by public entities are accelerating the pace of change. In addition to the public sector, the market itself is demanding green building practices from private developers who are finding that green building certification is a clear and strategic way to differentiate their product in a competitive market. These changes are not relegated to America or the West, they are happening everywhere – from new mandatory green building rating systems in China and Abu Dhabi, the movement around the world is clear. Given all of this, it is important to know what is meant by green building and how various definitions affect each project.
What is a Green or High Performance Building?
Green building is the practice of increasing the efficiency with which buildings use resources — energy, water and materials — while reducing building impacts on human health and the environment, through better and smarter site placement, building design and massing, construction techniques, building operations & maintenance, and waste reduction and removal — all affect the complete building life cycle and the costs that owners must manage.
As noted above in Figure 1, there is a spectrum of green buildings, showing that as a building’s performance increases the building’s ecological impact is reduced – this progression is indicated moving from left to right in the diagram.
Beginning at the left side, typical code-compliant buildings meet government regulations and/or common practices in the local market, nothing more.
The next level of performance is Better Building Practices. This level complies with an additional standard that is typically developed by local, regional, or state level governments, or the local building industry. This type of standard is generally slightly better than code but not as rigorous as the more recognized third party standards such as the US Green Buildings Council’s (USGBC) Leadership in Energy and Environmental Design (LEED) standard.
High Performance or “Green” Buildings are the next level. These are defined as LEED Silver or Gold buildings. For example in America, LEED Gold buildings, on average, perform 30% - 45% more efficiently in their energy use than average buildings.
The next level “Pursuing Sustainability” is where the concept of “net-zero” impacts begins to arise, in a variety of areas including energy, potable water use and waste. “Net-zero” energy refers to a building that produces as much energy in a year as it uses. LEED Platinum provides some recognition for this level of performance and the Living Building Challenge actually requires this level of building performance. It is worth noting that neither of these systems reaches the level of “fully sustainable”, a threshold that must be passed to move towards “restorative Buildings”.
Restorative Buildings are structures that gives back more resources than they consume. It is beyond “net-zero” and beyond simply “sustainable”. These buildings will generate more energy than they use, produce more clean water than they use, and will recycle/reuse more resources than they consume. This type of building is still just a vision, but the idea of restorative buildings is very compelling to the early adopters of green building who are currently pursuing “net-zero” and “Living” buildings with great enthusiasm.
