What are my rights if injured?

Under workers compensation laws workers, including casuals and most subcontract workers on ABNs, are covered by workers compensation insurance. This means if you are injured at work or on the way to and from work you get compensation. You are entitled to lost wages if you cannot work due to the injury and often extra money if you are badly injured.

The CFMEU are experts on workers compensation. Our solicitors specialise in workers compensation and often get better results than many other solicitors. We have many solicitors available to provide advice and help to injured workers. The union has helped thousands of subcontract workers on ABNs and even cash in hand workers who thought they had no rights or entitlements if they were injured. Some employers tell workers they are not protected by workers compensation insurance but this is very often not true.

The specific service offered by the CFMEU includes:
 Advising workers of their rights and entitlements;
 Assisting in making claims;
 Making enquiries with insurance companies as to progress or otherwise in processing of claims;
 Liaising with employers and insurance companies to ensure that proper entitlements are paid;
 Giving general advice on extra compensation rights for badly injured workers. Members are promptly referred to the union’s specialist solicitors TAYLOR & SCOTT, for claims to be pursued;
 Ensuring correct payment of entitlements including proper rates of workers compensation payment for public holidays, superannuation and redundancy benefits where applicable;
 Advising and assisting in claims for extra insurance coverage sometimes negotiated by the union including top-up (i.e. extra workers compensation) and 24-hour accident cover;
 Liaising with rehabilitation providers and referring members to MEND (building and construction industry coordinator) where appropriate;
 Reporting to WorkCover NSW employer breaches of the Workers Compensation Act and safety laws.
 Advising and assisting members to obtain long service leave entitlements on workers compensation.

What if I am underpaid or not paid at all?

Every day workers lodge complaints to the union about being underpaid or not paid. The union also often helps small sub-contract companies not paid by big builders. The union contacts the employer or builder and demands payment. Often there is negotiations and sometimes protests and rallies. If the union cannot solve a problem by negotiating or protest sometimes legal action is taken to resolve a problem.

In December 2007, 30 non-English speaking gyprock workers contacted the union because they had not been paid. The workers had been working on the construction of a luxury hotel. The employer and the builder refused to pay. The CFMEU organised a big protest at the site. All the workers participated. This protest with union flags and signs embarrassed the employer, the builder and the owners of the hotel. The union had decided to take the protests to the front door of the resorts of this hotel chain unless the workers were paid. Within two weeks the CFMEU recovered over $250,000.00 for the gyprock workers. This money was only paid because all the workers actively participated in protest action.

Superannuation

There is a special law in Australia which requires employers to pay workers an extra 9% on top of their ordinary (Monday to Friday) wages for superannuation. This benefit is not just for workers but also casuals and most sub-contract workers on ABNs. The majority of non-English speaking building workers are presently not receiving their superannuation benefits. This entitlement is worth $5,000.00 and even more depending on your wages each year. It is a legal entitlement. If you are not receiving superannuation you should come to the union and join the CFMEU superannuation scheme, CBUS. You then need to advise the union (confidentially if you like) of the name of the employer and what site you are working on. An organiser of the union can visit the site or ring the employer and negotiate that you and all the workers with your company receive their superannuation backpaid. We do not need to advise the employer which worker has made a complaint. Superannuation is important. It is money for your retirement so that you live with some dignity when you retire. Also, in the CFMEU superannuation scheme CBUS, there is insurance which provides a very substantial payment to a worker permanently disabled or to the next of kin e.g. mother or wife of a worker killed. The CFMEU urges you to stand up for your rights and ensure you are paid your legal entitlement to superannuation.
