Do I charge VAT for a private person in another EU country?

Hi everyone,

I have been requested to submit a quote for a translation for a private person in France (i.e. no international VAT number). Do I charge VAT on this at the German rate (or perhaps even the French rate?). I've search the forums without success.

Yes, as far as I know, if you are invoicing a private person, indeed you have to add the VAT, at your local rate in Germany.

This is just a quick answer; I am not sure I will find the time this afternoon to back it up with references. Nonetheless I am quite sure that you have to add the German VAT. Simply put: by default, you must add the VAT in force in your country, unless exemption applies. It does if the client is outside the EU, or if he/she is in another EU country and has an EU VAT number, or if you as a vendor are exempt of charging VAT (up to a certain sum you may choose this option in many countries).

From: Triacom Umsatzsteuerratgeber 2005 (made available by ADÜ Nord professional association). As far as I'm aware, this is still valid.

unless they can provide you with a valid VAT number, which then excuses them from being charged VAT by you.

Before you agree not to charge a client in another EU country VAT, you should always ask them for their VAT number and then try it in this box:

http://ec.europa.eu/taxation_customs/vies/vieshome.do

Only when you get a positive answer, that their number is valid, after doing this, are you free not to charge them 19% VAT.

While the information in the present thread is correct, it may be generalized incorrectly to EU customers who do not have an EU VAT number but are nonetheless considered as "taxable persons".
