What "certificado" does my Spanish client need so I can bill them from the U.S.?

As far as I know, such "certificados" are colloquially referred to as tax residency certificates. Thanks to the almighty Google, it wasn't too difficult to dig this up:

http://www.irs.gov/businesses/small/international/article/0,,id=122559,00.html

In case the link does not work, you need to be issued Form 6166 by the IRS. This is to be applied for by filling out Form 8802, Application for United States Residency Certification.

Of course, you will need to be set up in the US before you request this. So do wait for January 1st, I would think. From a quick glance at the instructions, it appears to me that there is no problem that 2012 will be your first year operating in the US. The IRS has foreseen this, and any in case, if you are requesting certification of residence for the current year, the only way for them to know that you are resident in the US and will file taxes there is your "signature under penalties of perjury" on Form 8802.

Enjoy the paperwork, and all the best for you in the new year in a new country!

Nicole, both the local Small Business Incubator and my accountant have told me that I do not, in fact, need the EIN to operate as a sole proprietor.

No, you don't *need* one as a sole proprietor, but you can get one. The main benefit would be to avoid having to give your out social security number (as a somewhat sensitive piece of information) to everyone who asks (e.g., for a W9. banking documents for business accounts, etc.). The "employer" part is a bid of a misnomer, as it is actually used to identify business entities (including sole proprietorships), irrespective of the existence or number of any employees.

I have fired two tax accountants until I finally found one who actually has a clue about small businesses. If you don't file your taxes as a small business, how will you be able to deduct any business expenses?

I'm lucky to have a good one also. Then again, even if she weren't, the fact that I'm married to her would make firing her kind of - what the word - awkward?
