Another spanish agency unwilling to pay" Nov 20, 2009

Thanks Tomas, will do! It seems that I hit a nerve with them precisely today when I told them that they are to expect a "requerimiento europeo de pago" these days.

Personally I think that the EU should promote a public record of bad payment practices among companies and public administrations (for instance city councils etc.), in the sense that if you have to resort to a small claims procedure, that fact would be public and seen by everyone.

Furthermore, companies with three successful small claims against them should be banned from contracting with the EU and all authorities of all 27 EU countries for a number of years. That would certainly give a big push against bad payment practices within the EU.

I am afraid that this will not happen during the next European presidency.
Spain would be, without any kind of doubt, at the list head of bad payors.

Try a cheap flight Nov 21, 2009

BTW: I really thank everyone from the bottom of my heart for her/his advice, but please DO take some time to read my postings! We are NOT talking about a TRANSLATION, for instance, and I am based in Germany, while they have their office in Spain - kind of hard to just drop by...

Air Berlin flights to Spain can be very cheap. I wouldn't hesitate to fly to Germany to reclaim a similar sum.

My two cents Nov 27, 2009

Hi,

As someone else has suggested, I would spread the word around, there are other lists where you can rate agencies other than ProZ. Inform this agency that you are going to write about their non-payment all over the web. This will make their life worse when trying to hire people. Use effective words and put pressure on them, politely but firmly.

Also, I would not start any legal action. You might end up paying more than what you are expecting to get. Try a collection agency instead. They'll do the dirty job for you. If you assign the job to an international agency with offices abroad (better in Spain in your case) that's a plus. This won't require any further investment from you. In most cases, if you get your money, 10% will go to the agency, so that would mean 1,800€ for you.

Need help... Dec 13, 2009

Anyone who could advise me on filling out this form correctly?

http://ec.europa.eu/justice_home/judicialatlascivil/html/epo_form1_en.jsp?txtPageBack=epo_filling_de_es.htm&countrySession=1&

I mean, perhaps someone already went through with it and can give me some orientation...
Basically I get lost right from the start: which language should I use? German, since the claim is coming from Germany? Spanish? Since the claim is going to Spain? How do I know the court data? Shall I try and find out over the Internet? Is it the one where the agency is based? Any advice/help will be greatly appreciated!

BTW: the agency has been hiding behind the false asseveration that the money had been withdrawn from their account. A quick inquiry with MY bank brought to light that this simply is not correct. In view of the mixed up data, there are only two options of what could happen: a) the transfer never took place b) the transfer was redirected to the originating account immediately.
So, my deadline has been drawn; and as they chose not to resolve things by then, not being overly cooperative either, all I need to do now is try and figure out this procedure...

Not to discourage you, but I have heard of occurrences in which an "agency" created fake bank or PayPal accounts in the names of their unpaid translators, wired money to these accounts and cashed it back again... There is no end to human wickedness.

Just to verify... Dec 14, 2009

The correct court would be the "Juzgado de Primera Instancia", right? What if they are numbered in the directory? Does it make any difference if I don't specify a number?

As I said: I'd appreciate some help!!!

Many thanks in advance!

Oh, something else: I found two different postal codes (ZIP codes) for the same address (on different sites stating the info), could anyone pls check this out with me, via PM if you like...

Anybody out there? ;-) Dec 14, 2009

Well, just to tell you that I filled out everything to my best understanding - but now what?
I hit the return button and got a nice PDF sheet with all the data I provided - am I supposed to fax it to the pertaining court, or what???

Can it be, that NO ONE here has done this before and hence give me some hints???

Txs anyhow for bearing with me
