Spain - Autonomo - Modelo 303 - Where to put EU vs Non-EU clients

Hi there,

I am working as an autonomo in Spain, first year successfully managed.

Although James and Emma suggested in my last topic at Proz to find a good asesor (which I will do for the annual renta declaration), I am keen on doing at least the 130, 303, 349, 347 and 390 myself. All seems pretty straight-forward, only the EU- and NON-EU-client work causes me a headache in the 303 modelo.

Lets assume for the 4th trimestre:
- 1xinvoice to ES client: 590 EUR (IVA incl, equals 90 EUR)
- 1xinvoice to NL client: 1000 EUR (VAT exempt invoice due to EU Directive, IVA would be 180 EUR)
- 1xinvoice to US client: 100 EUR (no VAT included, due to non-EU invoice, iva would be 18)

I would now put in the modelo 303:

Box 1: SUM=(500+1000+100), box 2: 18%, box 3: SUM=(90+180+18) EUR

Box 22 (where usually go the total expenses for the 4T): SUM=(1000+100+my 4T expenses)
Box 23: SUM=(180+18-IVA paid for 4T expenses)

Box 44: SUM=(1000+100)

Hi again fr54ert! (I thought you would be back soon with questions on boxes)

I suggest that you post questions on Spanish taxes in the "Translation in Spain" forum, preferably in Spanish, so that you get more people joining in on the discussion.

There was a useful thread there a few months ago on box 44.

As you'll see, there are some differences of opinion, depending on the person who happens to be on duty that day at Hacienda.

Boxes 1, 2, 3: This is only for IVA you've paid on invoices for Spain. So don't include EU or US invoices.
22 and 23: These are just for expenses (i.e. things you've bought, NOT services you've sold). It's not related to boxes 1-3.
So if you buy some ink cartridges that costs €100 + €18 IVA = €118 total then you'd put:
22: €100
23: €18 (transfer to box 37)
Box 38 = boxes 21 minus 37

Box 44: I understand the same as you, but opinions differ.

I suggest you go to Hacienda in person and talk it through with someone there, or at least ring them up (they're always very helpful, although they don't necessarily give you the right information!)

All I can say is that Hacienda told me exactly like I described it here. I have to add EU/Non-EU in Box 1+3 and later subtract again via Box 22+23. This is to ensure that the EU/Non-EU businesses show up in my business operations via the modelos. Plus list EU/Non-EU in Box 44.

I went to Hacienda with a plain 303 printout and asked the employee there to fill it out with exactly this examples. And she did as described earlier.

Well, all roads lead to Rome. I am sure if I ask 3 employees I will receive 3 different answers. So I most likely go with my initial approach, as the final number (resultado de liquidacion) doesn't change anyway.

PS: thank you for the forum category hint, will do so the next time. Although I am sure that there are many foreign autonomos who still prefer English information and will hopefully learn something, too, by reading our conversations.
