Individual rules enforcement actions should still be discussed via the support system, of course, but I wouldn't say it's one member versus ProZ.com in these scenarios, or at least that is not how site staff approach these issues. In the great majority of cases, rules enforcement action (which can be anything from a friendly communication with the relevant information to more serious action, in accordance with the infraction or the number of times a rule has been broken) actually leads to more positive participation and a better understanding of how the site works.

Yes. Most ProZ.com forums are public and can be indexed by search engines. In general, it is recommended that anyone using the Internet assume that anything they post online will be viewable by all people for the rest of time.
One exception are the ProZ.com private forums, which may be requested by members, and which can only be accessed by individuals who have been granted access expressly by the member(s) who own the forum. See http://www.proz.com/faq/3103#3103 for more information on how private forums can be created.
