Hola

Soy traductor en España y recientemente actualice my platinum membership.

Hoy he recibido una notificación de hacienda diciéndome que el número VAT de la factura de Proz es incorrecto, ya que empieza con las siglas EU cuando, según hacienda, debería comenzar por las siglas de un país. El número que recibí fue: VAT ID (Europe): EU276000137

Me gustaría saber si alguno de vosotros/as (residentes en España, sabéis cuál es el número VAT correcto de Proz (ya les he preguntado a los de Proz pero no me han respondido) para poder incluir esta factura entre mis gastos de est año.

Hola,

que yo sepa, para traductores autónomos en España el número VAT es el NIF, el NIE en el caso de los extranjeros. El NIE empieza por X, lo uso siempre en mis facturas, resulta correcto en el sistema europeo de verificación (http://europa.eu.int/comm/taxation_customs/vies/en/vieshome.htm) y lo he usado hace muy poco para "hacerme platino" en Proz sin ningún problema.

Gracias Arturo por tu respuesta, pero creo que me has entendido mal o yo me he explicado mal.

Ya se que el número VAT de un traductor autónomo en España es su NIF, pero lo que necesito es saber el número VAT de Proz (la empresa Proz) para porder incluir el IVA que me cobraron con el gasto del platinum membership en mis gastos anuales.

El hecho es que me cobraron IVA, y por lo tanto debería tener derecho a reclamarlo, el problemas es que, como Proz es de USA y me dieron un número VAT europeo es un poco lioso.

Vale, perdona: había entendido mal. Lo curioso es que te cobraron el IVA. Si no recuerdo mal existía la opción de indicar el número VAT del comprador justamente para que Proz no cargara el IVA. A lo mejor les puede resultar más sencillo emitir una nueva factura sin IVA si les comunicas tu NIE.

Proz.com es una sociedad registrada en los EEUU y por que yo sepa para cumplir con una medida europea sobre servicios por el internet se registraron también en Alemañía. Normalmente han de tener un número que empieza con DE y unas señas en Alemañia.

Creo que no deberían haberme cobrado el IVA, y puesto que le número que me dieron es incorrecto, es normal que hacienda me recrimine.

He llamado la atención de Henry a esto, ya que no entiendo bien el problema. En el recibo de ProZ, consta que la empresa puede emitir un certificado, ya que NO está inscrita como empresa alemana (y por lo tanto no valen las siglas DE; tienen que ser EU bajo el "special scheme"). En cuanto al IVA cobrado, lo que sé es que eso depende del status del comprador en VIES. Por eso, les he pedido que aclaren el asunto contigo.

El caso es que mi gestor me dijo que para dar un número fiscal, no era posible que tuviese las siglas EU en el comienzo del mismo, que siempre deben ser las siglas de un país europeo.

De todos modos, alguien de Proz me envió un email diciendo algo así:

"Desde julio de 2003, la Unión europea aprobó una directiva obligando a las empresas de servicios por internet a cobrar IVA (VAT) en ventas realizadas a personas (no empresas) residentes en países de la Unión europea. ProZ.com informa y envía el IVA (VAT) cobrado a Hacienda de Alemania, según el siguiente artículo "Special Scheme for non-EU Businesses Providing Electronically Supplied Services to EU Consumers".

Me han dicho que hay más información en el siguiente enlace oficial de la CEE ("Directive relating to VAT on digital services entered into force on 1 July 2003"): http://europa.eu.int/comm/taxation_customs/taxation/vat/traders/e-commerce/article_1610_en.htm

Lo he leído y le he pasado la información a mi gestor pero todavía no he obtenido respuesta.

ProZ.com's VAT number is EU276000137, we have been paying VAT quarterly since July, 2003, when the directive that required us to do so went into effect. Details are here: http://europa.eu.int/comm/taxation_customs/taxation/vat/tra ders/e-commerce/article_1610_en.htm

Our VAT number, issued to us under the "special scheme" for non-EU companies, is not verifiable using VIES. We were told it would be, but after two years, it is not yet. I find this situation rather unfair, but that is a problem we have had to deal with. Suffice it to say that VAT numbers *can* start with EU, so please ask your accountants to do their homework on that point. For further reference, if it is necessary, our contact country (not the correct term) is Germany.

There is an easier way to deal with this, though. To avoid having to pay VAT, be sure to enter your VIES-verifiable VAT number when making your membership payment. We are not required to charge VAT if you do this.

I would also like to clarify that the support ticket in which you asked about this issue, ACMTRAD, was answered in 3 hours and 10 minutes. I would appreciate if you give us more than a few hours before posting to the forums with this type of issue in the future.

Spanish accountants can be pretty dense, I've been thru a few accountants in different parts of Spain, and I know what reaction I'd get if I went armed with this kind of "up-to-date" info ...! I'd have to bend over backwards to prove it! In other words, you'd be doing the homework not them!

only companies with a valid EU VAT number are exempted of VAT on their European invoices. And Spanish freelance translators for whom I translate need to pay VAT on my Belgian invoice as they don't have a European VAT-number?

Did I get that right?

That goes for all of Europe.

The Spanish interpretation of this (Hacienda) used to put everyone who so requested on the register of intracommunity operators. Now there's been a movement to "cull" the register, meaning we are no longer VAT-exempt and are progressively being taken off. However, the letter of the law says, if the entity (or person) is on the VIES base, it/s/he is exempt.
