Agencies are sending tests to high quality translators and when they won the big project then they send the real big project to low rate & low quality translators. Even if tests are paid (I don't recommend to do free tests), this is basically a fraud: deceiving translators and end clients. One thing could work against that: spreading this information not only through translation/translators' channels, but through any other channels. End clients should be aware of this.
If end clients ask a test from an agency, they should also require a written guarantee that those translators will do the job, who submitted the chosen tests. Just as translators who are submitting such tests should ask the translation agency to sign a contract that if the agency wins the project, the won project must be assigned to the translator whose test was chosen by the end client.
