Für einige an Klatsch interessierte Leser werden die Wochenzeitschriften besonders attraktiv, wenn weibliche Prominenz aus dem europäischen Hochadel, zum Beispiel Caroline von Hannover, früher Caroline von Monaco, das Titelblatt schmückt. Ob beim Einkaufen, Reiten am Strand oder Tennisspielen mit ihrem Ehemann Prinz Ernst August von Hannover: das Privatleben der Adligen aus dem monegassischen Fürstenhaus wurde in den Neunzigerjahren ohne ihre Erlaubnis minutiös von der deutschen Regenbogenpresse dokumentiert. Caroline von Hannover fühlte sich in ihrer Privatsphäre verletzt und klagte teilweise erfolglos vor den verschiedenen Instanzen bis hin zum Bundesverfassungsgericht. Dies entschied in seinem Urteil vom 15. Dezember 1999, dass die Bilder, die Caroline bei der Ausübung ihres Privatlebens an öffentlichen Orten zeigen, nicht in ihr Persönlichkeitsrecht eingreifen. Solange sich eine Person an einem öffentlichen Ort aufhält, werde kein Schutz der Privatsphäre gewährt. Im Jahr 2003 zog Caroline von Hannover daher vor den Europäischen Gerichtshof für Menschenrechte. Die Fürstin beanstandete, dass der in Frankreich strenge Schutz des Persönlichkeitsrechts durch die Veröffentlichungen in Deutschland unterlaufen werde. Der Europäische Gerichtshof hatte daher zu prüfen, ob die staatlichen Maßnahmen zum Schutz des Privatlebens von Prominenten im deutschen Recht ausreichend sind. Gemäß dem Kunsturhebergesetz dürfen Privatpersonen, die als „absolute Personen der Zeitgeschichte“ qualifiziert werden, ohne vorherige Einwilligung fotografiert und das Material verbreitet werden. Zu absoluten Personen der Zeitgeschichte zählen neben bedeutenden Politikern, hochrangigen Wirtschaftsführern, berühmten Künstlern und Sportlern auch Angehörige regierender Königshäuser. Caroline von Hannover, als Sprössling eines europäischen Fürstenhauses, stellt also nach deutscher Auffassung eine Person dar, an der ein öffentliches Informationsinteresse besteht. Der Schutz vor der Veröffentlichung unangenehmer Fotos aus dem Privatleben ist nur dann gewährt, wenn die Person sich „in örtlicher Abgeschiedenheit“ aufhält. Örtliche Abgeschiedenheit bezeichnet nicht nur den eigenen häuslichen Bereich, sondern auch Orte in der die öffentliche Person objektiv erkennbar für sich allein sein will und in der sie sich in der konkreten Situation im Vertrauen auf die Abgeschiedenheit so verhält, wie sie es in der breiten Öffentlichkeit nicht tun würde.

Pour certains lecteurs amateurs de ragots les magazines hebdomadaires deviennent particulièrement attractifs lorsque la couverture arbore des célébrités féminines de la haute noblesse européenne comme Caroline de Hanovre, anciennement Caroline de Monaco. Que ce soit lorsqu’elle fait ses courses, du cheval sur la plage ou une partie de tennis avec son époux le Prince Ernst August de Hanovre, la vie privée des membres de la famille princière de Monaco a été minutieusement documentée, sans autorisation, par la presse people dans les années 90. Caroline de Hanovre s’est sentie atteinte dans sa vie privée et a déposé plainte, en partie sans succès, devant les diverses instances jusqu’à la cour constitutionnelle allemande. Celle-ci décida, dans son verdict du 15 décembre 1999, que les photographies qui montrent Caroline dans l’exercice de sa vie privée en des lieux publics ne constituent pas une violation du droit à la vie privée allemand (Persönlichkeitsrecht). Il n’y a pas de protection de la vie privée tant qu’une personne se trouve dans un lieu public. Ce pourquoi, en 2003, Caroline de Hanovre se tourna vers la Cour européenne des Droits de l’Homme. La princesse soutenait que le plus sévère droit à la vie privée français était bafoué par les publications en Allemagne. La cour européenne devait donc vérifier si les mesures étatiques pour la protection de la vie privée des célébrités étaient suffisantes dans le droit allemand. Selon la loi sur les droits d’auteur dans le domaine artistique (Kunsturhebergesetz) les particuliers qui peuvent êtres considérés comme des « personnalités de l’histoire contemporaine » peuvent être photographiées, et le matériel ensuite publié sans leur consentement. Parmi les personnalités de l’histoire contemporaine que sont les principaux personnages politiques, les dirigeants économiques de haut rang et les artistes et sportifs célèbres comptent aussi les membres des familles royales régnantes. Caroline de Hanovre, en tant qu’héritière d’une des maisons princières européennes, constitue donc, selon l’interprétation allemande, une personne d’intérêt public. La protection contre la publication de photos embarrassantes de la vie privée n’est de rigueur seulement quand la personne se trouve dans un « lieu retiré ». Sont considérés comme lieux retirés non seulement le domicile même et son environnement immédiat, mais aussi les lieux dans lesquels il est objectivement flagrant que la personnalité publique veut être seule et dans lesquels elle est suffisamment en confiance pour se comporter d’une façon telle qu’elle ne le ferait en public. |

I grew up with two languages, french and german, and I learned english at a very young age while living in an english speaking country.
I studied in Switzerland (in german at the Zurich University), in France (in french, with the CNED) and in England (in english, at Schiller International University).
I obtained a linguistics diploma and an MBA with a specialization in Tourism and Hotel Management.
Already during my studies I worked as a language teacher (french & german) and did various small translation jobs.
After graduation I spent several years working in the hotel industry in Asia. Later I worked in the field of development aid (NGOs and other donors) in various countries around the world. I had, during all my professional career, the opportunity to interpret and translate for my employers on a nearly daily basis.
When I returned to live in Europe, I finally entered the french public school system as a language teacher (this requires a translation exam).
I live in Africa now and I work as a freelance translator locally and worldwide.
