Por medio del presente instrumento, las partes convienen en modificar “el contrato”, en los siguientes términos:
1. Reemplazar la Cláusula Octava, sobre Multas, por el siguiente texto:
“XXXX” podrá aplicar a “XXXX” multas por atrasos en la entrega de los embarques del Producto, de acuerdo a la estipulación siguiente:
Por atraso dentro de los 15 (quince) días corridos siguientes a la fecha de entrega de cada embarque parcial del Producto, “XXXX” pagará un 0,0067% diario del precio total del contrato, o bien, la proporcionalidad que corresponda en caso que el incumplimiento sea parcial, y por cada día corrido de atraso adicional, al día 15, se aplicará un 0,1% diario, del precio total, o bien, la proporcionalidad que corresponda, montos que, a elección de “XXXX”, podrán ser descontados de los valores pendientes de pago a “XXXX” o haciendo efectiva la boleta bancaria de garantía, según corresponda.
Las estipulaciones precedentes no implican una renuncia de “XXXX” al derecho que le asiste a exigir el pago de las indemnizaciones que correspondan, por los perjuicios que el incumplimiento de “XXXX” pudiera irrogarle, en aquella parte que exceda a las multas establecidas en el presente contrato, haciéndolas efectivas con cargo a las garantías otorgadas o sobre otros bienes si fuere del caso.
Con todo, “XXXX” deberá reponer a “XXXX”, libre de todo costo, los billetes faltantes y los que presenten fallas imputables a su fabricación o sean rechazados por el control de calidad, aun cuando mediase recepción conforme y el pago de ésta, en un plazo no superior a 45 (cuarenta y cinco) días desde su notificación, durante la ejecución del presente contrato. El hecho podrá ser comunicado por “XXXX” dentro de los 2 (dos) años de haberse concluido la entrega del Producto sujeto a este contrato.

In case of a delay within 15 (fifteen) calendar days following the delivery of each partial shipment of the Product, “XXXX” shall pay 0.0067% daily of the total amount of the contract or the corresponding proportion if there is a partial breach of contract, and for every additional calendar day, after the fifteenth day, 0.1% of the total amount will be applied daily, or the corresponding proportion. If requested by “XXXX”, the above-mentioned amounts shall be able to be discounted off the pending payments to “XXXX” or making effective the bank guarantee certificate, whichever the case may be.
The previous statements do not entail that “XXXX” waives the right to demand the corresponding indemnity payments, due to the damages that the non-performance of “XXXX” may cause, in the part that exceeds the stipulated fines in this agreement, making them effective by charge to the given guarantees or to other goods.
“XXXX” shall replace to “XXXX”, free of charge, the missing notes and those that show factory defects or are rejected by quality control, even if the issuance of the invoice was performed as well as if its payment was completed, within a 45 (forty-five) day period counted from its notification, during the practice of this agreement. The situation may be conveyed by “XXXX” within 2 (two) years of the final delivery of the Product subject to this contract.

Southwest is an often told story, in an executive education. But there is an untold story about Southwest that’s very poorly understood and not widely known.
Segment 7 –
If you went out in 1968 and asked frequent business travelers in the State of Texas: “What do you want from an airline?” How many of them say: “We want to be treated like cattle when we get on and off the airplane; no assigned seats, please. How many say: “We don’t like to eat when we fly, no food”. How many say: “No inter-line ticketing, no inter-line baggage handling”.

You might also find it interesting… Guess what the number one request is in Southwest airline suggestion box from customers, every year, for the last thirty years? Number one suggestion in their suggestion box is…assigned seats. 185,000 requests last year. What’s number two? Food or more meaningful food than just peanuts. Number three and number four is inter-line ticketing and inter-line baggage handling. Please note: they have politely and deliberately refused all four of those requests for thirty years and there are number one on return on investment capital. So, clearly, choosing a winning customer centric solution is not the same as simply asking customers what they want.

Asimismo se desprende del estudio que solamente el 35% de la muestra ha comenzado a preparar su jubilación (el 46% entre los mayores de 45 años). Se puede concluir pues que los españoles empiezan tarde a preparar su jubilación.

My name is Silvina C. Jover. I was born in Argentina and raised in Uruguay. Since I was very young (around 3 years old) I started to learn English at a bilingual (British) school, until the day of my High School graduation.
When people ask me which is my mother tongue I see myself in a very awkward situation because I must say is Spanish, only because I was born and raised in a Latin-American country. But, in every day life, I consider myself a native of both languages: Spanish and English. The latter not only because I practically learned it as I was being taught how to speak, but also due to the fact that I'm married to an American and, nowadays, living in the USA.
Regarding my career, I've always been surrounded by legal topics. Also, due to the several languages I'm fluent at, my professional background has been among international companies focused in export and import matters. This experience has allowed me to expand my horizons to other subjects, besides Law.
Simultaneously, I had to learn about the different countries and their cultures. From a translator's point of view, this has taught me that a text can't only be translated literally. An in depth study of its context is needed, as well as a proper adaptation to be able to fit that particular piece of writing into the community in which will be exposed.
Considering that my life -professional and personally speaking- has always been related to the interpretation and translation of other languages, I've decided to offer my knowledge and experience to other individuals.
