Ich denke, dass es \"are\" heißen muß, da der Verweis sich sicher auf die Patente bezieht und nicht auf den Anhang. Letzteres würde doch sicher keinen Sinn machen. Ein Anhang ist doch immer \"incorporated\" in einem Vertrag.

disagree  Hans G. Liepert: der Bezug erfolgt eindeutig auf Exhibit A, damit: auf den ..Bezug genommen wird. Der Anhang ist im US-Recht eben nicht immer Bestandteil des Vertrags, sondern manchmal nur eine Erläuterung, eine Preisliste usw.
