“commission rogatoire”

Had the term been intended to mean “rogatory letter”, then I suspect that the term “letter rogatoire” would have been used. That said, I have found the term with this meaning on the Canadian Ministry of Justice site. What I’m unsure of with regard to that particular rendering is that it refers to the procedure, the means by which the end is achieved and not the authority by which the procedure initiated. However, I looked in the Merriam Webster dico and found that in English too, “commission” can be used perfectly in that context. This morning I have learnt something. Thank you to the others! COnfirmed also by my Dalloz FR/FR legal dictionary which desdcribes the term as being "un acte par lequel...".

I’m going ahead with my posting anyway as my findings and sources may be of use to you.

Lastly, a couple of years ago, I was called upon to give a witness statement in a criminal case, the police having contacted me under the terms of a “commission rogatoire” issued by the investigating magistrate handling the case.

Never the less and in spite of my lack of knowledge about the letter possibility, without further information, the safest translation would probably “rogatory commission”. Playing it safe does not necessarily mean that you get the right answer though and we are seriously lacking in context here. The most useful way to post is to paste up an extract of the original containing the term and providing any background information which may help provide a fuller picture. While I agree with the answers already given, a client French bank, considering a loan, refuses it automatically when there are "commissions rogatoires et enquêtes de police judiciaire" meaning ongoing action in another court against the applicant or police investigations. This may not be correct usage but is current.
