A trawl of the Registered Designs section on the website of the UK Patent Office\'s website shows registration is available if the design is 1. novel; 2. distinct and 3. has individual character.

Trademarks are defined under the UK CDPA 1988 below as \'any sign capable of being represented graphically\' and also need to be distinctive.

agree  gangels: absolutely, my learned friend. Perhaps 'uniqueness' would be an alternative

  -> Thanks. Uniqueness may denote a subtle shift to Einmaligkeit, or Einzigartigkeit. 'Eigenartigkeit' might be the borderline. Peculiarity and idiosyncracy are, I feel, discountable in this context.

agree  Mario Marcolin: distinctive it must be..
1 hr
  -> I reckon/guess so too.

neutral  Maureen Holm, J.D., LL.M.: copyright requires "originality", patent "novelty"
4 hrs
  -> Nice points. But this is a Geschmacksmuster> approx. registered design. Has to be novel and distinct: s.44 ('article') Registered Designs Act 1949 & Part IV UK Copyright, Designs & Patents Act 1988. Also Ford Motor's Designs (1995) RPC 167.

Eigentümlichkeit
novelty

Explanation:
In order to be patentable, an invention must have the following elements:

1. It must be new (the novelty requirement)

2. It must be useful (the utility requirement) and

3. It must be non-obvious (the non-obviousness requirement).

Try Googling "elements of patentability".
