(I'm using the singular, "it", referring to "surface", rather than "they", which would refer to "différences".) three suggested phrasings Explanation: "ll est précisé que toute différence entre les cotes de la surface indiquée ci-dessus et les dimensions réelles des Locaux ne saurait justifier ni réduction, ni augmentation de loyer, les Parties déclarant faire leur affaires personnelles de toutes différences de surface en plus comme en moins." The first difference described is : toute différence entre les cotes de la surface indiquée et les dimensions réelles. The second description of a difference is : toutes différences de surface, en plus comme en moins. The second description is a pain, as it adds nothing to the first one and makes the expression of the whole a little more awkward. It's redundant as Phil points out. It is illogical in fact. Nonetheless, redundancy is common in this type of agreement and it would be nice to find some elegant form of words. Here I think that means adding to the sentence in English. There are other possibilities too. First one : … that no difference between A and B shall… Second one : … of any such difference (The short version and one you might arguably get away with without betraying anything of the meaning) … of any difference between the area indicated and the area measured (the middle road) … in the event of the area indicated being above or below the actual measurement. (a rehash). I make the last suggestion as the whole phrase becomes awkward and illogical if you start comparing one are to another with reference to a difference which, as Phil points out, by its very nature one way or the other. The only way round that, is to compare the two expressions more directly and then describe the nature of the comparison. |
