4 +4 | The right to dispose of the title |

حق التفرغ عن حق الرقبة The right to dispose of the title Explanation: The term تفرَّغ or إفراغ means transferring [ownership] by selling or giving. I remember when I bought land in Saudi Arabia, my friends asked me هل أفرغ لك, meaning, did he sell it to you outright. In other words, did you actually receive the deed? The term حق الرقبة refers to the right to the title of the property, as opposed to the right to the use of the property. The latter is called حق الانتفاع. The right to both title and use is called الحق المطلق If you google these terms, you will find out how they are used in actual context. |
