Law/Patents - Human Resources / employment contract
English term or phrase: compensation earned by using his working capacity
Provisions in an employment contract:
The employer shall be entitled to release the employee from work until the end of the employment relationship. The release shall be subject to any offsetting of any claim to vacation to which the employee may still be entitled or any credit on the working time account. During the period of release the employee shall accept the offsetting of any compensation earned by using his working capacity against the claim to compensation vis a vis the employer.

I am not sure about the last sentence in this paragraph.
Perhaps the phrase denotes benefits provided by the Employer such as mobile phone, car, credit card (listed in another part of the contract), to which the Employee will not be entitled during the release period.

English translation:revenue earned by working (elsewhere)
Explanation:
The employee whose contract is being terminated may be told not to come into work during the notice period. However, if s/he uses that time to work elsewhere any income they earn during the notice period will be deducted from any claim they may have against the employer who is terminating their contract.

So, unearned income (i.e. not gained by use of their "working capacity") would not be offset, but income from either another employer or self-employment would be.
