Yes, it is badly written and ambiguous; but think about it. If it is the collection of the information that they are saying is lawful, then that implies very strongly that they are also unlawfully collecting information and they would hardly want to be saying that.

Yes, I am sure. Putting an adverb at the end of a sentence, where it becomes unclear which verb it modifies is not an unusual error in English and one has to resort to looking at the sense rather than rules of grammar to understand the intended meaning.
