Ky eshte term i permendur ne vendim divorci nga gjykata. Cifti ka bere martese ligjore por jo martese fakti. E di njeri se cfare eshte martesa e faktit?
Explanation: Termi ligjor është "De facto marriage" ose "Common-law marriage".
1. Common-law marriages are not licensed by government authorities, although they may be recorded in the public records of some governmental entities.
2. Common-law marriages are not solemnized.
3. Cohabitation alone does NOT create a common-law marriage; the couple must hold themselves out to the world as spouses; and
1. There must be mutual consent of the parties to the relationship constituting a marriage
2. Both parties must be of legal age to enter into a marriage or have parental consent to marry
4. In some jurisdictions, a couple must have cohabited and held themselves out to the world as husband and wife for a minimum length of time for the marriage to be recognized as valid.

Cohabitation has two meanings:
1. To live together as husband and wife, usually without legal or religious sanction.
2. To dwell with another or share the same place, under the same roof, without any husband-wife/partner relationship.
For two people to have a De facto marriage going on between them, ONE of the conditions they have to meet is for them to live together. (There are other conditions for two people to have a "De facto Marriage". See the explanation: "Cohabitation ALONE does not create a common-law marriage; the couple must hold themselves out to the world as spouses and:
1, There must be mutual consent of the parties to the relationship constituting a marriage;
2. Both parties must be of legal age to enter into a marriage or have parental consent to marry.")
Therefore, not everyone who lives together with another one, under the same roof, has a De facto marriage going on between them. They are just sharing the same living quarters.
That is why "De facto marriage" is the correct legal term and widely used for "martesë fakti".
A de facto marriage is a term used for certain couples who live together without being legally married. Recognition of de facto marriages varies by jurisdiction and entity. In some instances, an entity will recognize a de facto marriage, so that a person is eligible for the same rights as a legally married person. Some typical requirements are that a de facto spouse lives under the same roof as the member and that possessions have been pooled for joint use as a common household. It may also be referred to as "common-law union" or "cohabitation.
