-ترفع الدعوى في الحالات المنصوص عليها في هذا الباب بصحيفة تودع قلم كتاب المحكمة المختصة أو بالإدلاء بالطلبات شفويا أمام الكاتب المختص ويتعين على الكاتب إفراغ الطلبات في نموذج مطبوع يصدر بتحديد شكله وبياناته قرار من وزير العدل.
- على قلم الكتاب إخطار الخصوم بتاريخ أول جلسة لنظر النزاع بواسطة المحضرين أو بالطريق الإداري أو بالبريد.
- يقيد قلم الكتاب صحيفة الدعوى يوم تقديمها أو في سجل خاص بعد يثبت في أصل الصحيفة وصورها تاريخ الجلسة المحددة لنظرها، وعلى قلم الكتاب أن يسلم في اليوم التالي على الأكثر صورة الصحيفة لقلم المحضرين أو لجبهة الإدارة لتبليغها بالطريق الإداري أو طالب التبليغ ويجوز تسليم أصل الصحيفة وصورها للمدعى متى طلب ذلك لتقديمها إلى قلم المحضرين أو جهة الإدارة لإعلانها.
- أوجب القانون على المدعى لإمكان قيد الدعوى عدة أمور الواجبات الملقاة على عاتق قلم الكتاب
ما يتعين على المدعى عليه القيام به وصول إخطار قلم الكتاب إليه
لا يملك قلم الكتاب منع أي شخص من قيد دعواه

- لا يجوز إعلان صحيفة الدعوى مباشرة دون تقديمها وإيداع صورها التي حددها القانون قلم كتاب المحكمة.
من الواضح أنها جهة في المحكمة مسئولة عن تقييد الدعاوي وإخطار الخصوم بمواعيد الجلسات.
