المحكمة العامة هي المحكمة الابتدائية، وقاضي الدرجة العامة هو قاض المحكمة الابتدائية حيث تختص المحاكم الابتدائية بنظر الدعاوي الشخصية

نجيب على هذا السؤال بالنفي لأن محكمة الاستئناف وفق قانون الهيئة القضائية هي المحكمة المنشأة بموجب قانون الهيئة القضائية التي تتكون قضاتها من ثلاثة وتصدر أحكامها بالأغلبية ومن ثم فإن هذا التعريف لا ينطبق على المحكمة العامة لأنها محكمة ابتدائية ذات صفة استئنافية وعليه أرى أن نظر الدعوى من صميم اختصاص محكمة الاستئناف وعليه أرى إعادة الأوراق إليها للنظر موضوعاً .
