I wonder if the proper translation would be "and consenting to it"... not sure at all...

Whereas الموافقة is not limited to one individual involved in the transaction. In the context provided, though it does not indicate how many persons or entities would be involved, but all parties involved would have to agree upon all the preceding clauses of the transaction.
