The word Khalwa is translated as privacy.


"We should observe the rule of khalwa (privacy). Khalwa or privacy denotes a man and woman being alone in a place in which there is no fear of intrusion by anyone else, so that an opportunity exists for sexual intimacy. Islam prohibits khalwa between a man and a woman who are outside the degree of mahram relationship. The reason for this is not a lack of trust but rather to protect ourselves from sexual temptation arising when we are alone with a member of the opposite sex. The Prophet said: 'Whoever believes in God and the Last Day must never be in privacy with a woman without there being a mahram with her, for otherwise Shaytan will be the third present [with them]."

الخلوة الشرعية هي الخلوة التي حرمها الشرع وهي : ( الخلوة التي لا تمنع من الوطء )، أي إختلاء الرجل بالمرأة في مكان وحال لايمنع من فعل الجماع، قأيا كان هذا المكان في بيت أو خارجه وكان لا يمنعهما من الجماع أعتبر هذا المكان خلاء محرم اجتماعهما فيه، إما إن كان هناك ما يمنع من وطء الرجل للمرأة أعتبر المكان خلاء يجوز الإجتماع فيه وهو خلوة غير شرعية (أي غير محرمة)

أما أخي خروج الرجل مع إمرأة أجنبية للنزهة أو ما شابهه في الأماكن العامة، فهذا أمر ترتبط به أحكام أخرى غير الخلوة، وهو خروج محرم لأنه من مقدمات الزنا والوقوع في الحرام ودعوة إلى الفساد،حتى لو أذن ولي أمرها به.
وعلى هذا القياس الحديث إلى إمرأة أجنبية في الأماكن العامة، أو التعرض لها من دون غرض شرعي كالتجارة أو الدعوة أو أمر مباح، فهو من التعرض للأعراض وهو أمر محرم .

ج:الخلوة الشرعية هي أن يوجد رجل وامرأة أجنبية عنه في مكان لا يوجد معهما فيه إلا الله ثم الشيطان.فإذا كان معها في بيت لا يكون مختليا بها إلا إذا كان الباب مغلقا عليهما من الداخل.والخلوة بالأجنبية حرام بلا خلاف بين اثنين العلماء, وصدق رسول الله-ص-حين قال:"ما خلا رجل بامرأة إلا كان الشيطان ثالثهما".

So you think that the word "شرعية" is derived from "Sharia'" not الشرع!

They are asking whether to consider the marriage valid or not based on a private meeting without consumption!
That's all what is it about!

الخلوة هي انفراد الزوجين " شخصين" في غيبة عن أعين الناس ، في مكان ساتر، يمكنهما الوطء وإن لم يفعلاه، ويترتب على انفرادها حكم شرعي يؤثر فيهما أو في أحدهما.

It says in answer to people asking about الخلوة الشرعية whether what is meant is:
فإذا كان المقصود بالخلوة هي الخلوة التي يثبت بها المهر ونحو ذلك فراجع الفتوى رقم كذا وكذا:
which implies "Khulwa" has occured after عقد القران
Or
وإذا كان المقصود بالخلوة هي الخلوة بين رجل وامرأة أجنبية عنه تراجع الفتوى رقم كذا وكذا:
whether "Khuwa shar'ia" has occured between unmarried man and woman.

Yes the link includes different "Fatawas" concernig الخلوة الشرعية and their only concern is whether the marriage is valid or not if their was only a "Lawful meeting in privacy between husband and wife" not consumption of marriage "البناء"
