تعريف: حق التجريد هو حق الكفيل الذي يطالبه الدائن بأداء الدين، في إلزام الدائن بالتنفيذ على أموال المدين أولاً إذا هو بين له أن أموال المدين القابلة للحجز تفي بأداء الدين بتمامه، (م788) فالدفع بالتجريد إذن حق منحه القانون للكفيل يستطيع بمقتضاه أن يقف إجراءات التنفيذ على أمواله إلى أن يتم التنفيذ على أموال المدين أولاً ويتضح عدم كفايتها لوفاء الدين.
كما يستطيع بمقتضى حقه في الدفع بعدم جواز الرجوع عليه قبل الرجوع على المدين أن يدفع دعوى المطالبة الموجهة إليه على انفراد قبل مطالبة المدين:
المشرع إذن فرق بين مجرد مطالبة الكفيل قضائيًا وبين التنفيذ على أمواله، ذلك أنه خول الكفيل دفعًا خاصًا بكل من هاتين الحالتين.
