| Reference: 「代行」與「決行」 Reference information: 「代行」公文程式條例第4條第2項規定如首長因故不能視事由代理人代行首長職務時，其機關公文，除署長姓名註明不能視事之理由外，應由代行人附署職銜、姓名於後，並加註代行二字。性質上屬於法定代理之一種，係依法律規定，於一定事實發生時，機關首長之權限交由代行人行之。其特徵包括代行範圍為全部；被代行之首長對代行人無指揮監督之權，代行人自負代行之責；代行之發生、消滅，皆依法律之規定。 「決行」依機關內部權責劃分辦法，機關首長將部分權限授與下級公務員(通常為單位主管)行使。其基於授權而對外行文時，應以該被授權者之名義為之。公文程式條例第3條第3項稱為決行。其特徵包括授權範圍以一部為限；機關首長對被授權者有監督權，且須負連帶責任；可以任意發生或消滅授權關係。 http://www.justlaw.com.tw/News01.php?id=4130 |
