Materiální náležitosti notářského zápisu
Vedle formálních náležitostí, které jsou popsány výše, musí notářský zápis
také obsahovat i tzv. materiální náležitosti, které jej činí exekučním titulem odliš-
ným od jiných exekučních titulů uvedených v § 274 o. s. ř
A Notarial Record with a Direct Executibility Consent
The Czech legal order makes it possible for parties to secure the performance of
an obligation (e.g., the repayment of a loan, payment of a purchase price, etc.) – aside
from traditional legal devices such as a guarantee, contractual penalty, bank guarantee,
or lien agreement, etc. – by concluding an agreement in the form of a notarial record,
with a consent to its direct executibility. A directly executable notarial deed is an execution title.
