from sentence: Význam této funkce je v právní úpravě zdůrazněn požadavkem nezaměnitelnosti (§ 10 odst. 1 ObchZ), který je judikaturou posuzován s použitím pohledu průměrného zákazníka.

I can see that this is a requirement for leaving no open room for confusion (of a commercial name), but is there a legal term covering it? thanks!

Co tak takto.:-) Vyznam je rovnaky a imho to lepsie znie. Samozrejme, pre adjektivum a sloveso sa confused/confuse hodi viac.
