offence or crime charged
Explanation:
at the time of the action he is charged with

påsigte: charge

påsigtet forhold:
offence charged
crime charged
alleged crime

(Helle Pals Frandsen: Dansk- Engelsk Juridisk Ordbog / Gyldendals Røde)

How exactly you phrase it depends on whether he has been convicted yet. It sounds as if he has, and now the question is whether he was fully compos mentis or something like that.

If he has actually been convicted, then you can say at the time of the offence charged, while alleged deliberately keeps open the possibility that he may be innocent.
