Overigens weze opgemerkt dat zelfs in de hypothese dat het niet-concurrentiebeding aan alle geldigheidsvoorwaarden zou voldoen, het toch geen uitwerking heeft wanneer aan de overeenkomst een einde wordt gemaakt :

... bij een afwijkingsbeding van niet-concurrentie, indien de bediende om dringende reden in hoofde van de werkgever een einde maakt aan de arbeidsovereenkomst.

I am puzzled why it is "in hoofde van de werkgever" - if the white-collar worker is not being fired but is leaving voluntarily (which it seems to imply" then why is there a compelling reason on the part of the employer.
