Without knowing the content of repliek under 50, I would say this is expression the lawyer refers to. The bear being the potential clients including Vogel, and ZZZ not agreeing with them ever having been potential clients. I hope this makes sense ;-)

It sounds like something to do with raising new issues that have not been dealt with, probably with a pun on the name of the company. But if all you native Dutch speakers don't know what it means, I wouldn't hold out high hopes of getting a translation. I'd ask the customer.

het gaat om een faillissement en of de advocaat van de failliet aansprakelijk gehouden kan worden voor de schade. Ik wil niet teveel tekst geven want het is wel vertrouwelijk maar de tekst die ik gegeven heb is een hele paragraaf in de conclusie. Niets daarvoor en niets daarna. Ik heb wel naar de conclusie gekeken waarnaar het verwijst en daar wordt over 2 potentiële klanten gesproken, die dan verloren zijn gegaan omdat het bedrijf failliet ging. Een van de bedrijven heet Vogel maar de andere niet, dus ik weet niet of ze proberen een soort woordenspel te maken. In ieder geval de laatste commentaar van Barend is misschien relevant - ze proberen te zeggen dat ze niets van deze klanten af wisten tot nu toe?...

Ik zou graag wat meer context over deze zaak horen. Het zou een variant kunnen zijn op "ze zien vliegen". Maar waarom eea op gezag van YYY, dat is moeilijk te begrijpen met de beperkte gegeven context.

I mean XXX sees on the authority of YYY previously unmentioned facts (nieuwe vogels) that have not yet been dealt with (nog niet geschoten)

However, ZZZ disputes these new facts.

I don't think this should be taken literally or that it is in any way related to hunting. It seems to be a metaphorical expression created by the author to evoke a certain image or sentiment. Does your context not offer any pointers? It might be helpful if we could see the wider context, f.i. the lines that preceed and follow your highly enigmatic sentence.

Frank, I think with the "op gezag van" they mean on authority of, ie. that person told them something which made them see the new birds...thanks for your comments but still none the wiser!

yes, very odd. If the context has nothing whatsoever to do with birds, or hunting, then one way you could handle it is by enclosing a quite-literal translation in double quotes and inserting a (sic).
However, I can't figure out how "op gezag van" fits into this, as if XXX was ordered to see those fluffy things. Is het repliek op gezag van, of het schieten op gezag van?

especially because the phrase "Het hier gestelde wordt door ZZZ betwist" follows. This means it refers to facts.

I have never heard this expression used before and, indeed, there are no references to be found either. I guess you will have to go by the context in order to grasp the intended meaning of this apparently highly idiosyncratic expression.
