Dutch term or phrase: ontbindende voorwaarde

I want to say "non-binding condition" but someone told me it should be "resolutive condition." Legal is not my thingso I don't usually take on texts with legals terms . . . I'm just helping out a friend with this text, but I want it to be right. Can anyone tell me what it should be in the following context?

"Aan deze schenking wordt een ontbindende voorwaarde van overlijden van uw echtgenote binnen de drie jaar gekoppeld..."

ondition subsequent n. 1) in a contract, a happening which terminates the duty of a party to perform or do his/her part. 2) in a deed to real property, an event which terminates a person's interest in the property. Examples: if the Dingbat Company closes its business, a supplier will not be required to fulfill its contract and deliver gidgets to the company and the contract will terminate; if daughter-in-law Beatrice terminates her marriage to Reggie Fauntleroy, her interest in the real property will terminate and revert to the grantors, Mom and Dad Fauntleroy. Een ontbindende voorwaarde is "een ontsnappingsmogelijkheid in een koopcontract. Als aan de gestelde voorwaarde niet wordt voldaan, kan de overeenkomst worden beëindigd. Gebruikelijk zijn bijvoorbeeld een voorbehoud financiering, woonvergunning en het verkrijgen van Nationale Hypotheek Garantie."

Suspensive conditions: When a contract is subject to a suspensive condition, the contract comes into effect only if the condition is met. For example, a sale of a Picasso painting may be made conditional upon the painting being authenticated by an art expert within 10 days. The entire contract of sale is then suspended until the expert authenticates the painting, and if this is not done within the agreed period, the contract simply falls away.

P.S. The meaning of the words you have quoted is that the gift only comes into effect if the spouse dies within three years. That is what it says. It seems very curious. If it means the opposite, i.e. that the gift only comes into effect if the spouse survives beyond the three years, which is more likely, then the Dutch you have quoted is using the wrong term. If you have the opportunity to query the use of this term in your document, I would do so.

Het type voorwaarde dat aan de schenking is verbonden is bepalend voor het moment van aangifte i.v.m. verschuldigde successierechten. Er kan sprake zijn van een ontbindende voorwaarde (resolutive) of een opschortende voorwaarde (suspensory). Zie onderstaande link voor een heldere uitleg :-)

En nog een correctie :-) Het gaat hierbij uiteraard niet om verschuldigde 'successierechten' (want die worden door de schenking juist vermeden) maar om 'schenkingsrechten'.

En dan nu echt een laatste aanvulling: 'opschortende voorwaarde' wordt vaker vertaald met 'suspensive condition' dan 'suspensory condition' (zie ook antwoord Textpertise).
