"Indien de bezwaarde een of meer afstammelingen nalaat, zullen het voorwaardelijk karakter van de verkrijging door de bezwaarde en de beschikking ten behoeve van de verwachter vervallen indien hetgeen de bezwaarde uit mijn nalatenschap heeft verkregen krachtens een door het overlijden van de bezwaarde bekrachtigde uiterste wilsbeschikking door middel van een erfstelling of legaat (anders dan een vruchtgebruiklegaat) toevalt aan de verwachters."

So far I have gone under the basic assumption that Van den End's solution for this (testamentary disposition) is accurate. However, in a recent conversation about this particular sentence, a former prospective civil-law notary pointed out that a testamentary disposition is the same as a 'beschikking bij testament', what, interestingly enough, is not per se an appointment as a beneficiary. Apparently this can also relate to administration, executorship, etc. Van Dale gives 'appointment/institution of an heir' as an option, but is either one acceptable? Or is there another solution for this?
