"De werknemer die schade toebrengt aan de werkgever of aan een derde tegenover wie de werkgever tot vergoeding van de schade verplicht is, is tegenover de werkgever verplicht tot vergoeding van de schade, indien deze schade is veroorzaakt door een handeling of nalaten die voor rekening van werknemer komt, mits werknemer direct of indirect in verband met die aansprakelijkheid *een beroep toekomt op een verzekering*, en anders alleen voor schade die is veroorzaakt door de opzet of bewuste roekeloosheid van werknemer."

I believe this phrase means that the employee who is responsible for causing damage to property of the employer or a third party is entitled to avail him-/herself of coverage. Question is: how should this be properly rendered? RSVP ASAP TIA. Cheers, Rob

Explanation:
"Een beroep toekomt op" should probably be interpreted as "een beroep kan doen op". If that is not the case, "mits ... een beroep toekomt op" would have to be translated as: 'provided insurance cover accrues to the employee ...'

"Een beroep toekomt op" should probably be interpreted as "een beroep kan doen op". If that is not the case, "mits ... een beroep toekomt op" would have to be translated as: 'provided insurance cover accrues to the employee ...'
