VERGRIJPBOETE
Een vergrijpboete wordt opgelegd bij opzet
of grove schuld. De [belasting]inspecteur moet hierbij aantonen dat daarvan sprake is.
Onder grove schuld wordt verstaan ernstige
nalatigheid of ernstige vormen van slordigheid
waarvan de belastingplichtige redelijkerwijs
had moeten begrijpen dat zijn gedrag tot gevolg
kon hebben dat te weinig belasting zou worden
geheven of betaald.
Bij vergrijpboete wordt ook onderscheid gemaakt tussen aanslag- en aangiftebelastingen. Bij een aangiftebelasting wordt een vergrijpboete opgelegd als niet binnen de gestelde
termijn wordt betaald.
