“In Interpretation of Judgments Nos. 7 and 8 (Factory ay Chorzow), speaking of ‘those points in the judgment in question which have been decided with binding force’ and of ‘a part of the judgment having binding force’, the Court made it clear that not all parts of a judgment have such force. Later in the same case Judge Anzilloti, dissenting, said that ‘the binding effect attaches only to the operative part [le dispositif] of the judgments and not to the statement of reasons’…

Het "beschikkend/besluitend gedeelte" is dat deel van het document dat over het besluit gaat. Het is dus een deel van het document (fysiek aan te wijzen), inhoudelijk is het het besluit. Als je googlet op "operative part" krijg je weinig resultaat, in feite alleen 1 EU document, en de niet unaniem gesloten proz discussie. Voor de rest verwijst "operative part" naar andere zaken. Ik ben helemaal geen juridisch expert, maar operative part lijkt me een rare vertaling.
