De rechtspraak is hierin zeer soepel. Het precieze basismisdrijf moet niet worden aangetoond. Het volstaat dat men elke legale herkomst van de fondsen kan uitsluiten. De praktijk leert dat deze vereiste uiterst ruim wordt opgevat en dat de rechters op basis van slechts loutere indiciën tot de conclusie kan komen dat de gelden geen legale herkomst kunnen hebben. |
