In principle the community comprises all the present and future property of both spouses, except:
- Assets which have been obtained from the will of a testator or by means of a gift and where the testator/donor has provided that these assets will not fall within the community (by means of an exclusion clause (uitsluitingsclausule), Art. 1:94 para. 1 Dutch Civil Code).

Uitsluitingsclausule in het testament
Een uitsluitingsclausule is een regeling die kan worden opgenomen in een testament om te voorkomen dat die nalatenschap of schenking in de gemeenschap van goederen terecht komt van de begunstigde. Door de uitsluitingsclausule komt de nalatenschap in het privé-eigendom van de begunstigde. Als u namelijk iets persoonlijks wil nalaten aan een ander die getrouwd is in gemeenschap van goederen wordt het geërfde ook mede-eigendom van zijn/haar huwelijkspartner. Als u uitdrukkelijk niet wil dat het in de gemeenschap van de goederen komt van de door u begunstigde, dan kunt u dat op laten nemen in uw testament.
