Afdwingbaarheid is undoubtedly enforceability, but one must query why partijovereenkomst is used instead of overeenkomst tussen partijen. Essentially all overeenkomsten are between parties, one therefore wonders if this refers to a special class of contract/agreement, i.e. a party agreement. Just a thought.

Besides, the law regarding Legal Aid stipulates the necessary requirements for the mediators, who make referrals for the Legal Desk and the Administration of Law. Based on this law, the Legal Aid Council has legal authority for the management of this register. The norm for registration comprises specific requirements for the training of the mediator and registration with the NMI, as well as availability requirements.
The law also arranged the possibility of De wet regelde ook al de mogelijkheid van de afdwingbaarheid van partijovereenkomsten. This is not a specific arrangement with regard to mediation, but could be used for that purpose: mediation agreements can be incuded in a notarial act and they are then afdwingbaar op basis van artikel 430 lid 1 rv .
