Law/Patents - Law (general) / pleadings/conclusies
Dutch term or phrase: proceshouding
"Dit is geen loyale, verstandige, eerlijke en bijllijke proceshouding. Het komt de rechter toe een deloyale procespartij te straffen" (verwijzing naar Cassatie van 14 maart 2002).

I understand this to mean attitude towards the proceedings, but is a more technical term appropriate and if so what is it?

conduct over/during/in (the course of the) proceedings
Explanation:
The conduct in proceedings is in no way sincere, prudent, honest or reasonable.

bijllijke should probably be billijke by the way.

Jurlex gives similar examples, but... never can be too certain about jurlex sometimes:

"106. ... en wier proceshouding geenszins rechtvaardigt dat zij haar eigen kosten zou moeten dragen."

"106. ... and whose conduct in the course of the proceedings has in no way justified an order that it should bear its own costs."

And

http://is.gd/u1rl7l

"39. ... Wanneer een lidstaat door zijn proceshouding de bij de verdragen aan de Commissie opgedragen taak van hoedster van de communautaire rechtsorde bemoeilijkt, is een ernstige reprimande stellig op zijn plaats."

"39. ... There is no question that where the conduct of a Member State in proceedings impedes the Commission in its role, entrusted to it under the Treaties, as the guardian of Community law, that Member State deserves to be strongly reprimanded."

Ah, yes, re: billijk I was merely pulling from Vandale @the moment. "just and equitable" for "eerlijk en billijk" is probably better in any case.

(AmE) litigation conduct; (BrE) litigation stance

Explanation:
Behaviour during trial might be off-beam.

Litigation conduct in the UK might be confusable with conducting of lawsuits.

Example sentence(s):
  • Tougher sanctions for frivolous litigation conduct in New York State courts are in place as of March 1, 1998, when amendments to 22 NYCRR Part 130 took effect. lazar-emanuel.com/Stiffer%20Sanctions%20For%20Frivolous%20Litigation%20Conduct.pdf
  • sensible advice coupled with a tough litigation stance.
