I understand what the asterisked phrase means but would welcome any help finding the proper 'legalese' wording. This part concerns the direct application of treaty provisions in the national legal system.
In de jurisprudentie zijn criteria ontwikkeld aan de hand waarvan kan worden bepaald of een verdragsbepaling rechtstreekse werking heeft. Het is aan de nationale rechter om vast te stellen of een nationaal voorschrift in een bepaalde situatie wegens strijd met deze bepaling buiten toepassing moet worden gelaten. Bij de beoordeling of een verdragsbepaling rechtstreeks kan doorwerken in de nationale rechtsorde wordt gekeken naar de aard en de inhoud van de bepaling, alsmede de formulering daarvan. Gaat het om een bepaling die tot de burger is gericht en deze **een aanspraak geeft waarvoor geen nadere uitvoeringswetgeving noodzakelijk is**, dan kan die bepaling rechtstreeks in de Nederlandse rechtsorde worden toegepast. Indien het gaat om tot de Staat gerichte bepalingen, waarbij in de formulering bewoordingen als ‘zorgdragen voor’, ‘maatregelen nemen’ of ‘waarborgen’ voorkomen, dan is over het algemeen geen sprake van een bepaling waaraan burgers rechtstreeks aanspraken kunnen ontlenen en dus geen sprake van een bepaling die rechtstreeks in de nationale rechtsorde kan doorwerken. Slechts indien een tot de Staat gerichte bepaling naar aard en inhoud zodanig duidelijk is dat een burger daaraan een aanspraak kan ontlenen, kan rechtstreekse werking van een dergelijke bepaling aan de orde zijn. Te denken is bijvoorbeeld aan een tot de Staat gericht discriminatieverbod, waaraan een burger een aanspraak op gelijke behandeling kan ontlenen. |
