agree  Deborah do Carmo: thanks very much for clarifying that Marion - "uitlating" here was throwing me, to sum up then final statements before pleadings are closed and BEFORE oral evidence begins (a document commenting on the exhibits filed at the rejoinder stage)

  -> jus to be sure: 'uitlating' in this context does not refer to anything oral. From the st. of claim up to the st. of comments on exhibits, everything is a paper exchange of arguments. Thereafter, the court might call for a hearing or render its decision.
