Maar hoe vertaal je zoiets nou op een goede manier die ook nog een beetje begrijpelijk blijft?

Meer context is er niet, het is deze losse opmerking in een tabel waarmee kan worden bepaald of iets Nationaal of Europees moet worden aanbesteed. Het komt verder in het hele document niet terug.

The European Union is updating the rules concerning procurement procedures for public works contracts, public supply contracts and public service contracts. This revision is based on the fundamental principles of the internal market and basically strives for simplification, harmonisation and modernisation. It introduces a new procedure - the competitive dialogue - and promotes the development of electronic procedures. Recourse to social and environmental criteria is authorised for the selection of economic operators and is based on Court of Justice case-law.

2004/17/EG en 2004/18/EG
In 2004 is de Algemene Richtlijn voor werken, diensten en leveringen samengevoegd in het document 2004/18/EG. In deze nieuwe richtlijn zijn tevens een paar belangrijke wijzigingen doorgevoerd. Dit geldt ook voor de Richtlijn voor Nutssectoren. Deze is aangepast in 2004/17/EG. De richtlijn dient door de overheden uiterlijk 31 januari 2006 te zijn opgenomen in de nationale wetgeving.

BAO en BASS
De Nederlandse overheid heeft in juli 2005 het Besluit Aanbestedingsregels voor Overheidsopdrachten (BAO) en het Besluit Aanbestedingsregels voor Speciale Sectoren (BASS) vastgesteld. In deze besluiten worden resp. de richtlijnen 2004/18/EG en 2004/17/EG opgenomen in de nationale wetgeving. Deze besluiten zijn ingegaan op 1 december 2005.
