De maatschappij treedt van rechtswege in de rechten van de verzekerde of van zijn rechthebbenden ten belope van de betaalde bedragen en in de mate van de aansprakelijkheid van de derde.

De betaalde vergoeding wordt beschouwd als één en ondeelbaar en als globaal voorschot op een later >verhaal<.

In geval van gedeelde aansprakelijkheid zal de maatschappij haar >verhaal< uitoefenen ten belope van het deel van haar uitgaven dat overeenstemt met het deel van de aansprakelijkheid dat ten laste van de derde wordt gelegd."
