"xx heeft niet duidelijk gemaakt waarom yy dan toch als behoorlijk bestuurder van die opzegging (van zijn arbeidscontract) af had moeten zien. Dat geldt temeer nu als niet, althans onweersproken vast staat dat zz als (mede)bestuurder van xx niets heeft gedaan om de opzegging van de arbeidsovereenkomst of van de distributieovereenkomst ongedaan te maken."
Es geht darum, dass Geschäftsführer yy vorgeworfen wird, er habe seine Pflichten als Geschäftsführer der Gesellschaft xx verletzt. zz ist der andere Geschäftsführer.
Dieses "nu als niet, athans onweersproken vaststaat" bereitet mir einiges Kopfzerbrechen. Es kann doch nur entweder niet oder eben doch (nicht widersprochen) feststehen. Ich habe den Eindruck, der Satz stimmt so nicht, oder sehe ich das ganz falsch? |
