I am looking for a word describing a person who caused damage covered by any insurance, e.g.TPL. I don't think it is the above..., but maybe that will help to figure out what I am interested in.

What is the specialist term? Do you have any suggestions?

No, you are probably right... perpetrator implies an element of criminal damage.

"Person who caused the damage" may be more appropraite

If the person who caused the damage is not insured or has not been identified, then the claim can be submitted to the Fonds de Garantie Automobile. ...

Asker: And even in the contex of insurance? So, e.g. the injured party can make a claim against the damage perpetrator? Because within isurance types claims can be made due to different TPL. So the damage perpetrator woulsd be universal enough for all these insurance contexts?
