in fact it is a case taken to the court by a number of consumers against Earthlink Inc. those consumers signed a contract with it and payed fees for necessary equipment.they could not get their money back and wanted to make a case for being cheated. what I understood is that they,at the beginning, could not make it since the agreement made with the copmpany precluded class actions. this is why the court released a decision making this contractual provision barring class actions unenforceable. |
