English to Arabic translations [PRO] Law/Patents - Law (general)
English term or phrase:absolute discharge
Hello,
It is a term related to law. All what I know about it is the English definition. Those terms along with their definitions are related to British law as it is mentioned.
Absolute Discharge :
"the court takes no further action against offender, but the offence and the discharge will appear on his criminal record".
I would like to know its equivalent meaning in Arabic. By the way I have a law dictionary,Faruqi's Law Dictionary, but could not find the meaning. I would be grateful to get a help from u.
Explanation: It is important to realize that "discharge" in "absolute discharge" does not mean "dropping the charges" or "dismissing the case." Only the defendant is dismissed.
In some countries, the offense remains on the reconrd. In some other countries, the record is wiped clean. But the chrages are not dropped.

Here is what Wikipedia has to say about the topic:
"In Britain, an absolute discharge is a decision given by a court in which no sentence is given but in which a criminal conviction is recorded in the offender's criminal record. Under the Crime and Disorder Act, 1988 an absolute discharge can only be granted in exceptional circumstances."
The same encyclopedia also reports:
"In Canadian law, an absolute discharge is a sentence that carries no penalty nor conditions and leaves no criminal record. It is used in cases where a defendant pleads or is found guilty of a crime but where it is not thought appropriate to punish him or her."
thank you for answering. In fact the first answer which is اسقاط التهمةبشكل مطلقdoes not go with the definition that says the offence will appear in the one's record.i was not totally convinced with the second answer that includes سرايا النيابة.Is it the same as court? I do not really know. There are maybe similar answers to some extent but i took the time factor into consideration. THank you for all of you. I would like to say that sometimes the treanslated terms are influenced by the register used in one country may be different from that of another which can at least makes slight difference even though we all understand the definition in the source language. 4 KudoZ points were awarded for this answer
Regarding the last note added, I would like to say that it is not a matter of tendencies. Those are supposed to be specific terms used in specific cases. So the translator's tendency for simple answers or even complex should be away when selecting the translated term.As a student, I tried to go over the definition thoroughly as well as the answers. It is true that the contextual meaning implied is important to be conveyed when translating, but as I have said earlier those are only terms which have specific definitions. In other words, one can know the explanation of such terms and translate it accordingly but what if the translator knows the meaning of those terms.I hope u get my point. Do you have any suggested translation of such a term that can convey the textual meaning implied but should be known to the reader or listener as a term used in law? The only thing that makes the translation sometimes varies is the register used in this case. THis term is used in UK and it may have another meaning in my country or urs.I wish I could meet a lawyer and ask about that.
Apparently, there is a tendency to select simple answers that do not readily convey the contextual meaning implied. The translator must try to make the reader/listener of the translation associate it with the implied context in which it is used.
You chose the best answer in my view. It was great of Fuad to come with this term.
