The term “medicinal product” based on the definition “by virtue of its presentation” has been subject to the ECJ jurisdiction from the early times of EU pharmaceutical legislation. One of the basic considerations of ECJ in its judgment concerning the interpretation of the term “medicinal product” was and is the primary purpose of EU pharmaceutical law, laid down in the 1st recital of Dir. 65/65/EEC. The primary purpose of EU pharmaceutical legislation is “to safeguard public health”.

mislim da je ovo smisao "u grubo" a da će ga trebati vješto uklopiti u rečenicu... mislim da se radi o tome da je po jednoj definiciji medicinskog proizvoda medicinski proizvod onaj koji je kao takav prezentiran, tj. koji je pakiran tako da upućuje da je medicinski proizvod, na kojem stoji opis koji upućuje da je to medicinski proizvod, i sl. možda bi se čak moglo reći koji je deklariran kao medicinski proizvod...

A product recommended or described as having prophylactic or therapeutic properties is a medicinal product "by virtue of its presentation" within the meaning of the first subparagraph of Article 1(2) of Directive 65/65 on proprietary medicinal products, even if it is generally regarded as a foodstuff and even if in the current state of scientific knowledge it has no known therapeutic effect.
